Terms and Conditions

1. Scope
   These General Terms and Conditions (GTC) apply to all deliveries by PSE - Priggen Special Electronic GmbH to consumers and business customers.

2. Contractual Partner
   The purchase contract is concluded with: PSE - Priggen Special Electronic GmbH, Rothenberge 60, 48493 Wettringen, Germany. 3. Offer and Contract Conclusion
   3.1 The presentation of products in the online shop does not represent a legally binding offer, but an invitation to order. All offers are valid "while stocks last," unless otherwise noted for the products. Errors are excepted.

3.2 By clicking the 'Submit Order' button at the final step of the order process, you accept the GTC and place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email after receiving your order. The automatic message from our online shop acknowledging the receipt of your order is not an order confirmation!

4. Right of Withdrawal
   4.1 Consumers have a legal right of withdrawal.

You can revoke your contractual declaration within 14 days without stating reasons in written form (e.g., letter, fax, email) or - if the goods have been handed over to you before the deadline - by returning the goods. The withdrawal period begins after receipt of this information in written form, but not before the goods have been received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery), and also not before we have fulfilled our information obligations according to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To meet the withdrawal deadline, it is sufficient to send the withdrawal or the goods in a timely manner. The withdrawal should be addressed to:

Exclusion from Return

• Goods that are custom-made according to customer specifications or clearly tailored to personal needs, as well as materials cut to length as per your order, or goods that are not suitable for return due to their nature, or can spoil quickly, or whose expiration date has passed,
• Audio or video recordings or software, provided that the delivered data carriers have been unsealed by you,
• E-books, newspapers, magazines, and periodicals.
  The right to warranty remains unaffected in the case of defective custom-made goods.

Consequences of Withdrawal
In the case of an effective withdrawal, both parties are required to return the services received, and any benefits derived (e.g., interest) must be surrendered. If you cannot return the received service either fully or partially, or can only return it in a deteriorated condition, you are obligated to compensate us for the lost value. This does not apply if the deterioration is solely due to the inspection of the item, as would have been possible in a physical store. Additionally, you can avoid the obligation to compensate for any deterioration resulting from the intended use of the item by refraining from using the item as if it were your property and avoiding anything that could diminish its value. Items that can be shipped as a package must be returned at our risk. You are responsible for the cost of returning the goods if the delivered goods correspond to the ordered ones, and if the price of the returned goods does not exceed 40 euros, or if, for a higher price, you have not yet paid the consideration or a contractually agreed partial payment at the time of withdrawal. Otherwise, the return is free of charge for you. Items that cannot be sent as a package will be collected from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your withdrawal declaration or the item, for us with its receipt.

5. Prices and Shipping Costs
   5.1 The prices listed on the product pages include the statutory value-added tax (VAT) and other price components. We strive to keep the prices in the online shop up to date, but this may not always be possible.
   Upon placing your order, you will receive a response from the shop system. This is not yet an order confirmation! The order confirmation with the price, shipping costs, confirmation of availability, and indication of delivery time will be sent to you in a separate email.
   All bank transfer fees must be paid by the customer. Discounts will not be granted unless otherwise agreed. We process orders only with a minimum order value of EUR 40.00. For orders with a value below EUR 40.00, we charge an additional processing fee of EUR 15.00 per order. Orders can be placed by email, using our order form in the online shop, or by fax at 02551/82422. After receiving your order, we will send you a confirmation email that includes our bank details, should you choose to pay via prepayment. Customers from EU countries must provide their VAT identification number (VAT No.) on all orders. If no VAT number is provided, we will apply the currently applicable VAT rate in Germany.

5.2 In addition to the prices listed, we charge a flat shipping fee of EUR 9.50 per order for delivery within Germany. The shipping costs will be clearly stated on the product pages, in the shopping cart system, and on the order page. Cash-on-delivery shipping fees are currently at least EUR 15 (domestic). Shipping costs are applicable within the Federal Republic of Germany and may vary depending on the order volume and the weight of the shipment. The actual shipping costs, including for international orders, will be communicated in the order confirmation or upon request.
For more favorable shipping costs, we recommend prepayment after receiving our order confirmation. Deliveries outside of Germany are only possible with prepayment.

5.3 For payment by cash on delivery, an additional fee of EUR 2 will be charged, which the delivery service will collect on-site. No further taxes or costs will apply.

6. Delivery and Availability
   6.1 Delivery is available worldwide. Please note that shipping costs vary by country and continent. We will inform you of these costs in the order confirmation or upon prior request. Deliveries outside Germany are only possible with prepayment.
   6.2 Delivery dates and deadlines are non-binding unless expressly agreed otherwise in writing.
   6.4 A prerequisite for the agreed delivery date is correct and timely self-delivery. If there is a delay in delivery, the customer may withdraw from the contract after setting a grace period of at least four weeks in writing (e.g., by registered letter). Withdrawal from the contract must also be in writing. If delivery becomes impossible due to the supplier's or manufacturer's inability to deliver, both parties may withdraw from the contract if the delivery date is exceeded by more than two months. In cases of force majeure and other unforeseeable, extraordinary, and unavoidable circumstances, the delivery period will be extended accordingly. If these circumstances make the delivery impossible, we are released from our obligation to deliver. Should we be released from our delivery obligation due to a delivery delay or impossibility, the customer cannot claim damages as long as they have been properly notified by us.

7. Payment
   7.1 Payment can be made either via prepayment or cash on delivery.
   7.2 If you choose the prepayment option, we will provide our bank details in the order confirmation, and the goods will be delivered upon receipt of payment.
   7.3 You are only entitled to offset your claims against ours if your counterclaims are legally established by a court or recognized by us in writing.
   7.4 You may only exercise a right of retention if your claims arise from the same contractual relationship.

8. Retention of Title
   PSE - Priggen Special Electronic GmbH (the seller) retains ownership of the goods until full payment is received and all past, present, and future claims/invoices have been settled. Resale is only permitted if ownership retention has been agreed upon.

9. Warranty
   Warranty is provided in accordance with legal regulations. For all defects that occur within the statutory warranty period of two years from delivery, you have the legal right to subsequent performance (your choice of defect rectification or replacement), and - under the legal conditions - the right to reduction or withdrawal, and possibly damages. You must allow us two attempts to rectify the defect. If your chosen method of subsequent performance is only possible at disproportionate cost, your claim is limited to the other method of subsequent performance.

10. Place of Fulfillment and Jurisdiction
    The place of fulfillment for all services and the place of jurisdiction for both parties is Wettringen.

If you wish to purchase the products in the shopping cart, click 'Proceed to Checkout'. Please then enter your details; required fields are marked with an '*'. After entering your data, please review your entries again. By clicking the 'Submit Order' button, you complete the order process. You can cancel the process at any time by closing the browser window. On the individual pages, you will find additional information, e.g., about correction options.

Data Protection
We use the data you provide to fulfill and process your order. Your data will be passed on to the shipping company responsible for delivery, as far as this is necessary for the delivery of the goods (name, address, and possibly telephone number for coordinating delivery times). To process payments, we may pass on your payment data to our bank.
If you use the customer login, you can view the stored data.
Without using the customer login: After the contract has been fully processed and the purchase price has been paid in full, your data will be blocked for further use and deleted after the expiration of the tax and commercial law retention periods.
